1. Agreement

These terms govern rentals of reusable moving totes from Tote Genie ("we", "us", "our"). By reserving totes, paying an invoice, or taking delivery, you agree to these terms. If you book for a business, you confirm you can bind that business.

2. Rental Period

The rental starts on the scheduled delivery date and ends on the scheduled pickup date shown on your reservation or invoice. Totes stay our property. You receive them for the rental period only, and you do not acquire title to them.

A longer rental, early return, or extra pickup must be agreed with us. Extra time may be billed at the rate in effect when the rental is extended.

3. Delivery and Pickup

We deliver to and pick up from the addresses you give us, within our service area. You are responsible for accurate addresses, access instructions, parking, gates, stairs, and a way for us to reach you.

  • Someone 18 or older should be present, or you should leave written instructions we can follow.
  • A missed delivery or pickup caused by incorrect access information, or by nobody being available when we require it, may be rescheduled and may include a trip fee.
  • Have the totes empty, closed, and ready at the pickup location on the pickup date.

4. Care, Damage, and Loss

Use the totes for ordinary household moving. Do not load a tote past its labeled capacity or any weight limit we publish. Do not use totes for hazardous, illegal, perishable, or leaking contents.

  • Return totes clean and in the condition you received them, ordinary wear excepted.
  • You are responsible for loss, theft, and damage beyond ordinary wear, including missing lids or totes, up to the replacement cost we quote.
  • Tell us promptly if a tote is damaged, lost, or stolen.

5. Late Returns

If the totes are not ready on the pickup date, or we cannot collect them for a reason on your side, the rental continues until we collect them or you return them. We may charge additional rental fees for each extra day or rental period they remain out, at the rate then in effect.

6. Payment and Deposits

Quotes, invoices, and any deposit are due as stated when you book. We may require payment before delivery. If totes are missing or damaged beyond ordinary wear, we may charge the replacement or repair amount, including against a deposit.

Unpaid amounts may delay pickup, delivery, or a future rental. You are responsible for taxes and fees that apply to the rental.

7. Cancellations

You may cancel before the delivery date. Any cancellation window or fee stated at booking applies. Cancellations after we have dispatched, and missed deliveries caused by access problems, may be charged a trip fee. Amounts already earned for a completed delivery are not refunded except where required by law.

8. Liability

You pack and are responsible for the contents of the totes. To the extent the law allows, we are not liable for indirect or consequential damages, or for loss of or damage to those contents. Our responsibility for a rental is limited to the amount you paid us for that rental.

Nothing in these terms limits liability that cannot be limited by law, including liability for injury caused by our negligence.

9. Governing Law

These terms are governed by the laws of the state or province where Tote Genie operates, without regard to conflict-of-law rules. Our principal place of business is Nanaimo, British Columbia. Courts in that location may hear disputes arising out of a rental, except where applicable law requires a different venue.

11. Updates

We may update these terms. The date at the top of this page is the date of the current version. A rental already booked follows the terms posted when you booked, unless the law requires us to apply a change sooner.
